When you decide on a band name there are two options 1) you register the name right away and acquier all rights and privileges to it, if someone else is using it you'll know pretty quickly 'cause you wont be registered 2) you don't register and use the name. In case 2, you'll be getting a letter asking you kindly to stop using that speciffic name if there is a band with the same name. Consult with someone who knows the law in your country before going through with anyting. I know the situation in Belgium, not in the entire world.
P.S.: Let it be obvious that you can't use the name of a very popular band, because in that case the assumption will be made that you are trying to cash in on their succes.
